Terms of Service

These Terms of Service ("Terms") govern your access to and use of the job.technology platform and services (collectively, the "Service") operated by job.technology ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service is available exclusively to users located in the United States. Access from outside the United States is not permitted.

1. Acceptance of Terms

By creating an account or using the Service in any way, you represent that you are at least 18 years of age, are physically located in the United States, and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform at least 30 days before they take effect. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.

2. Description of Service

job.technology provides an AI-powered platform that includes job listings, resume and career tools for job seekers, and hiring and recruitment tools for employers. The specific features available to you depend on the subscription plan you have selected.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

AI Tools Disclosure

The Service uses artificial intelligence to generate, analyze, and modify job descriptions, resumes, cover letters, and other career documents. AI tools may also be used in job matching and recommendation features. You acknowledge and agree to the following:

  • AI-generated content is for presentational and informational purposes only. It does not constitute a guarantee of accuracy, fitness for hire, or any particular employment outcome.
  • You are responsible for reviewing and verifying all AI-generated content before using or publishing it.
  • Users who are subject to AI-based matching, scoring, or evaluation have the right to request human review of such outputs where required by applicable US state law (including, without limitation, applicable provisions of the Colorado AI Act and EEOC guidance on AI in hiring).
  • Employers who use the platform's AI hiring tools may have independent legal compliance obligations under applicable law, including but not limited to New York City Local Law 144, the Colorado AI Act, and EEOC guidance. Employers are solely responsible for their own compliance with these requirements.

3. User Accounts

To access most features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information as needed
  • Keep your password confidential and not share access with others
  • Notify us immediately of any unauthorized use of your account
  • Be physically located in the United States when accessing the Service

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to the following:

Billing

Subscriptions are billed on a recurring basis (monthly or annually, depending on your selection). Your payment method will be charged at the start of each billing period.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will not receive a refund for the current period unless required by applicable law.

Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect, and you may cancel your subscription if you do not agree to the new pricing.

Taxes

All prices are exclusive of applicable taxes. You are responsible for any taxes, duties, or levies required by your jurisdiction.

5. Acceptable Use

You agree not to use the Service to:

  • Post false, misleading, or fraudulent job listings or profiles
  • Harvest or scrape user data without authorization
  • Upload viruses, malware, or other harmful code
  • Violate any applicable law or regulation, including employment discrimination laws
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use automated systems (bots, scrapers, crawlers) to interact with the Service without written permission
  • Impersonate any person or entity, or misrepresent your affiliation with any organization
  • Circumvent geographic access restrictions through the use of VPNs, proxies, or other means

Anti-Discrimination Requirements

In compliance with Title VII of the Civil Rights Act, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), and applicable state and local anti-discrimination laws:

  • Employers are prohibited from posting or using AI-generated job descriptions that encode discriminatory language based on age, gender, race, color, religion, sex, national origin, disability, or any other protected characteristic under applicable US federal or state law.
  • Employers are solely responsible for reviewing all AI-generated job descriptions for legal compliance with anti-discrimination laws before publishing them.
  • Employers are prohibited from using the platform's AI tools to make fully automated hiring decisions without meaningful human review where required by applicable law, including NYC Local Law 144 for employers using automated employment decision tools in New York City.

Resume and Profile Accuracy

Job seekers are prohibited from submitting resumes or profiles that contain materially false information. AI enhancement of resumes and career documents does not relieve the job seeker of responsibility for the accuracy of the underlying factual claims.

6. Intellectual Property

The Service and its original content (excluding content provided by users) are and will remain the exclusive property of job.technology and its licensors. Our trademarks, logos, and service marks may not be used without our prior written consent.

Your Content

You retain ownership of any content you submit or create using the Service ("User Content"), including resumes, cover letters, and job descriptions. By submitting User Content, you grant us a non-exclusive, royalty-free license to use, store, display, and process that content solely as necessary to provide the Service to you.

AI-Modified Content License

When you use our AI tools to generate or enhance job descriptions or employer materials, you grant us a limited license to process and modify that content using AI systems for the purpose of delivering the Service. You retain ownership of the resulting output.

AI Training Data

We will not use your personal resume content or job-seeking materials to train AI models without your separate, explicit opt-in consent. You may opt in or opt out of AI training data use through your account privacy settings. Withdrawing consent for training data use does not affect prior processing.

AI-Generated Content and Copyright

AI-generated outputs produced using our tools are provided to you for your own use. You are responsible for reviewing and ensuring the accuracy of any AI-generated content before using it. Purely AI-generated works without human authorship may not qualify for copyright protection under current US law. Content that you substantially modify or that reflects your own creative input may qualify as a copyrightable work.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Job listings on our platform are provided by third-party employers, and we do not guarantee the accuracy, completeness, or availability of any listed position.

AI Content Disclaimer

  • AI-Enhanced Resumes: Resumes and career documents generated or enhanced using our AI tools are based on information you provide. We do not warrant the accuracy, completeness, or fitness of AI-enhanced resume content. You are solely responsible for verifying all factual claims.
  • AI-Generated Job Descriptions: Job descriptions generated or enhanced using our AI tools are starting drafts only. Employers are solely responsible for reviewing AI-generated job descriptions for legal compliance, accuracy, and non-discriminatory language before publishing.
  • AI-Assisted Label: Content that was substantially generated or modified by AI tools will be marked as "AI-Assisted" or "AI-Enhanced" where required by applicable law or platform policy.
  • Algorithmic Ranking: Job matches, candidate rankings, and recommendation features use algorithmic scoring. These rankings are not endorsements. The platform does not guarantee any employment outcome arising from algorithmic matching.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JOB.TECHNOLOGY, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

The Service is intended for use by persons located in the United States. The platform makes no representation that the Service complies with the law of any jurisdiction other than the United States. Access from outside the United States is not permitted.

The Company is not responsible for any employment discrimination claims arising from an employer's use of AI-generated job descriptions or AI-assisted hiring tools. Employers are solely responsible for their own compliance with applicable anti-discrimination law.

If any provision of these Terms is found unenforceable in your jurisdiction, the remainder of the Terms shall continue in full force and effect.

9. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, circumvention of geographic access restrictions, or use of the Service in a manner that exposes the Company to legal liability.

You may terminate your account at any time by contacting us or through your account settings. Sections of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, disclaimers, limitations of liability, and the arbitration and class action waiver provisions.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Binding Arbitration

EXCEPT AS OTHERWISE PROVIDED IN THESE TERMS, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, INCLUDING THE EXISTENCE, VALIDITY, OR TERMINATION OF THESE TERMS, SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION BEFORE A SINGLE ARBITRATOR ADMINISTERED BY JAMS PURSUANT TO ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, OR (FOR CONSUMER DISPUTES) PURSUANT TO ITS STREAMLINED ARBITRATION RULES.

The arbitration shall be conducted in Delaware, unless you and the Company agree otherwise. The arbitrator's decision shall be final and binding, and judgment may be entered on it in any court of competent jurisdiction. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs this arbitration provision.

Class Action Waiver

YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.

Opt-Out Right

You may opt out of the arbitration and class action waiver provisions of these Terms by submitting written notice via our contact form within 30 days of first accepting these Terms. Select "Legal" as the subject and include "Arbitration Opt-Out" in your message. If you opt out, all disputes shall be resolved exclusively in the state or federal courts located in Delaware.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights. Small claims court actions within the applicable jurisdictional limits are also excluded from the arbitration requirement.

11. Geographic Restrictions and Access Policy

The Service is available exclusively to users located in the United States. Access is restricted at the network level for users whose IP address resolves to a location outside the United States.

  • The Service is not available to users in OFAC-comprehensively-sanctioned jurisdictions (currently including North Korea, Iran, Syria, Cuba, and the Crimea, Donetsk, and Luhansk regions of Ukraine), regardless of any future change to the geographic access controls.
  • Users must not circumvent geographic access controls through the use of VPNs, proxies, Tor, or other means. Circumvention of geographic restrictions is a material breach of these Terms and may result in immediate account termination.
  • By using the Service, you represent and warrant that you are physically located in the United States and are not acting on behalf of any entity or individual in a prohibited jurisdiction.
  • The Company reserves the right to modify geographic access restrictions at any time without notice.

If you believe you have been incorrectly blocked, for example, because you are a US resident accessing the Service through a corporate VPN with a foreign exit node, please contact us for assistance.

12. Employment Agency Disclaimer

job.technology operates as a passive online job board and career tools platform. We are not an employment agency, staffing firm, or placement service. We do not:

  • Select, recommend, or place candidates in employment positions on behalf of any employer
  • Guarantee that any user will obtain employment or that any employer will find a suitable candidate
  • Charge placement fees or collect compensation contingent on successful hires
  • Enter into any employment relationship with job seekers using the platform

Hiring decisions are made exclusively by employers. The Company is not a party to any employment relationship formed through the use of the Service. Users in US states with employment agency regulations should consult applicable state law to understand any independent obligations that may apply to their activities on the platform.
